Royalties... a week later

Over the past few weeks I've corresponded with literally thousands of internet radio listeners, most of them amazed that their calls actually made a difference. Well they did. Even the most entrenched industry can be resisted by a large and engaged public. To see your voice in action, see Rep. Jay Inslee (D-WA) speak forceably on the House floor in support of the Internet Radio Equality Act (IREA), which picked up 5 more co-sponsors this week (up to 139 and counting...).

Inslee Floor Pix.png

As you know, the enormous public pressure has propelled us into a supervised negotiation phase. This has begun gingerly, under the watchful eyes of the many representatives who've been moved to participation through your calls. We've begun a dialogue with SoundExchange to agree on a rate that is fair to both webcasters and artists.

It's a difficult process, and your ongoing calls continue to make a HUGE difference. Make no mistake, it's your efforts that initiated this negotiation, and it's critical that the momentum continues with the Internet Radio Equality Act. To see if your representative has stepped up, see the official sponsor list. Many have yet to act in spite of a deluge of constituent phone calls. If you haven't called yet, it's not too late. Just visit savenetradio - all you need is to type in your zip code and you'll get the contact info. It's a quick call.

The IREA has both a version in the Senate (Bill# S1353) and House of Representatives (Bill# HR2060), so we're seeking the support of both houses.

Thanks again, and stay tuned...

Good to hear. I've had better luck lately getting through on my daily calls. Not sure if that's good or not, but my two cents are getting registered.

BTW, the link on the main page to the latest SaveNetRadio situation is still pointed to last week's post.

Tim, don't forget about us Canadians! I have to resort listening to Geico commercials to get my music.

This is great news. I was studying abroad in Beijing for a while and when I received the emails I only managed to make one call to Diane Feinstein via Skype, but the connection was horrible. I'm finally back in the States, though not for long, and have just finished calls to both Diane Feinstein and Barbara Boxer, good thing Mr. Honda is already a co-sponsor of the HR bill. Please keep us up to date, no matter where I may be in the world, I hope to come home to good music in this land that should remain free, as it was always meant to be.

Isn't it funny how this all transpires...? Not so many years ago, former President Bush called out ICE-T and Body Count along with the entire political community and enforcement agencies over Body Count's "Cop Killer" and slammed Warner Brothers and the music labels for promoting "damaging music to our youth" and the political engine was against the record companies claiming they were 'reckless'. Here we stand a few years later with Congress trying to protect the record labels and multi-millon dollar music execs who screw over the artist with minimal royalties and make major salaries...all because they weren't smart enough to see the upcoming change in technologies that revolutioned the music world to a truly global forum.

I guess it's all in who is willing to contribute more to the campaign funds... hmm, maybe we should tell Congress we'll pay a lower rate in fees to them directly (vs SoundExchange) if they'll change their tune (AGAIN!) Then, we can work the two against each other to negotiate a better competitive rate for all? Wait, that would be American, enforced under laws against monopolies, and might actually mean we cared about the freedom of speech globally. My bad.

Good to see some progress here at least and Tim, thanks for the time and dedication you and your staff are devoting. We'll keep emailing and calling!

What is the latest situation in the UK? - I've just read that on July 1st UK licencing authorities announced fees even higher than those in the US and that Pandora, Launchcast and Last FM will be forced to close or stop streaming to the UK. Please fight this as vigorously as the US situation otherwise there will be a complete shutdown of internet radio in the UK. There is a higher percentage of people in the UK who regularly buy music than in any other country in the world, making it the world's most vibrant market for music. If you allow internet radio to die in the UK then this market will be severely harmed. Only a handful of radio stations in the UK give airtime to musicians and bands that are not being pushed by the major record companies meaning that independent artists and bands will have no effective means of getting people to hear their music. This will be a disaster for the UK music industry.

And I can assure you that anyone in the UK who has listened to Pandora will want Pandora to launch in the UK later this year as planned. I haven't heard anything about the UK situation on this blog so please fight this ruling for the sake of all musicians and bands who want to reach into the UK market and for all of us in the UK who love music. If you do we will be very grateful to Pandora.

I certainly think it is important to let our representatives know how important internet radio is to me. I can pick the best type of music for me. That should not mean it gets taxed higher than anything else. I'll help by voicing my opinion because Pandora is tops in internet radio.

Posted by: Karen Taylor at July 27, 2007 04:57 AM

Could you please clarify what the situation is in the UK? There has been very little reporting on this so far - the Guardian Newspaper being the only media outlet so far to cover the story. If we know exactly what this means for internet radio in the UK we can start contacting our Members of Parliament.

Seems like this GA rep (Rep Deal, Nathan [GA-9] - 5/17/2007(withdrawn - 5/23/2007))needs some work as he was sponsoring it and then withdrew it.
Make sure you check back often, in case your rep pulls a switcheroo on you too.

I am a soldier deployed to Iraq. When I am not engaged in combat operations I like to escape into my music. Pandora is my link to escape the stress and fatigue. I sleep to it. I wake up to it. I study to it. I share it with my family as they wait for my return. My stations link us together literally 1/2 way around the world. My children and my wife go to bed listening to the same station I am listening too and look out the windows at the same moon I am looking at and we are connected. I hope they don't take that away from me and my family

I truly do not understand why they would want to kill internet radio. I have been exposed to so many new artists and songs from my favorite artists, that other wise I would have never known. This led me to purchase some of their CD's and songs, that I never would have, with out first hearing them on Pandora.

I love the idea behind the "Music Genome Project" and everything Pandora stands for. I am calling my representative as soon as I finish clicking the post button.

God speed guys, and please know that your fans are with you and behind you no matter what.

Would having an auction site generate more revenue?

http://www.marketwire.com/mw/release.do?id=753684&sourceType=3

"
Century Group's (CEYG.PK) BroadcastBid.com Saved the Internet Radio Star?

As New Royalty Rates Loom, a New Revenue Model May Bail Out Internet Radio Stations

ORLANDO, FL--(Marketwire - July 23, 2007) - Internet radio stations are facing what popular Internet radio provider Pandora.com's founder calls "an ill-conceived attempt to crush" Internet radio. The Copyright Royalty Board has recently announced that it insists that Internet radio stations pay a per-song licensing fee that represents a huge increase in the royalty fees required for Internet radio stations to operate. What's more, the CRB has insisted that these royalties are retroactive to 1998, which could add up to "tens of thousands [more royalties] in arrears" according to usatoday.com.

"BroadcastBid.com was conceived as a source of non-traditional source of revenue for traditional broadcast stations," says Dan Bordui, President of Century Group, US (PINKSHEETS: CEYG). "We have always intended to expand that model to offer other broadcasters an additional source of revenue as well, but have been focusing on our core competencies first. However, when we heard about the new royalty rate hike, it was immediately apparent that we'd need to work out a way to partner with Internet radio stations as soon as possible. They're in trouble, and we think that BroadcastBid.com could be exactly what they need to help them out. As a non-traditional source of revenue, BroadcastBid.com can't be beat; it's free for the radio station and can generate unlimited amounts of revenue. Our most successful station group earns over twenty thousand a month in revenue off our product, so huge Internet radio providers such as Pandora.com or Last.fm, who have a much larger listener base than most radio stations do, should be able to earn even greater revenue. And, of course, an online auction site that's tied to a Internet radio station is an awesome revenue combination."

According to an Arbitron study, Internet radio listeners are more likely to be educated than their counterparts (12% more likely to have a college degree), are predominantly male (67% male), and are more likely to have a household income of over $50K a year (12% more likely).

This is almost the exact same demographic spread as eBay's visitor base, as compiled from their own user tracking statistics. A quarter of eBay's users are in the 18-34 demographic, with more than half of them making between $25K and $75K a year. Combine this with the fact that almost 60% of Internet radio users listen to Internet radio while shopping online according to Arbitron, and a clear potential market emerges.

"Century Group's BroadcastBid.com is the right product, at the right time, for the right price," Bordui continued. "We offer a revenue-sharing online auction platform that radio stations can use to directly monetize their listening audience. This is exactly what Internet radio needs at this moment, and we're happy to be able to provide this service for them."

For more information on BroadcastBid.com, or to see Century Group's Safe Harbor Act Disclaimer Notice, go to www.BroadcastBid.com.

About Broadcastbid.com:

BroadcastBid.com is entering the marketplace with a unique product that fills a definite need in traditional media companies and which will offer auctions similar to eBay that may find it increasingly hard to attract revenue from modern Internet media users. BroadcastBid.com offers radio stations different ways to generate non-traditional revenue, from set-price sales to classifieds.

About Century Group, Inc:

Century Group provides exciting new opportunities in non-traditional revenue and content offering in the online media space to compliment offline advertising and marketing. Century Group is currently investigating partnerships to provide traditional media stations with value-added opportunities to generate revenue and enhance profitability while providing the consumer with addictive and recurring content that will drive those revenues for the broadcasters.

Hey Tim,

I sent an email recently to SOCAN, the agency that controls the payments to artists performing in Canada.

My question was "I was wondering if you could comment on whether SOCAN was actively working with the staff at Pandora or any of the the US government agencies responsible for enforcing these restrictions (e.g. RIAA) to try to resolve licencing issues so that Canadians can regain access to this most important service for Canadian and international music.

Unfortunately the response was not entirely positive.

"SOCAN pays royalties for performances on radio, television, film and live performances. Although we currently have a proposal on the table with the government for internet performances (tariff 22), SOCAN currently does not issue licenses or pay royalties for use of music on the internet. Since this license is still awaiting approval, SOCAN is not aware or involved with the Pandora restrictions (to Canadians).

Kindly feel free to contact us at the toll free number below should you have any further questions in this regard. "

Kind regards,
Awelana Nabina
Information Officer / Agent d'Information
Nabinaa@socan.ca

The changes to Tarriff 22 is looking to change the way that Canada views copyright and more specifically copyright violations. As you may be aware, today, Canada does not view downloaded music, copied music from Radio, copied pages from library books, etc. as a copyright violation.

As others above have said "please don't forget about Canada."

Querido Tim: Me gusta mucho la musica que se presenta sobre la red mundial por PANDORA y tus locutores. (I love the music you present over the worldwide web via PANDORA and your jockeys.) No puedo imaginar un mundo sin este servicio. (I can't imagine a world without this service). I have written to our local Tennessee congressmen and am waiting with anxiousness to see what develops. Living in Nashville, I hear both sides of the issue. Royalties should not be compromised
but neither should the express listeners of this country or the world. Sharing should not have fees yet I know that there are those who would be willing to pay for such fine webcasting as Pandora puts out. But until that hand is forced we should continue the fight for this great freedom of expression. Ultimately, this is a civil rights issue. Maybe PANDORA can approach a few of the artists here in Nashville to get with this very important voice and not just condemn it. Music is like the Bible it will not be denied. Sinceramente, El Clavito

I am the father of two brain damaged children. The school system simply could not handle them and we homeschool as a result. My wife and I are also both disabled. This means we are all always together at home which I wouldn't trade for the world. The get to learn about what interests them at the moment in their own time. Be it science or art or really anything at all. Pandora has become a staple at this house to introduce them to the wonders of music, dance and language (they sing along and learn how to talk and understand complex topics better). Pandora makes this ever so simple because I can tailor the station to exactly the music they like with a simple thumbs-up or thumbs-down. The vast repertoire of music Pandora has means they are constantly finding new and exciting songs to sing and dance along to; coupled with their old favorites that Pandora remembers always means a fun hour or two each day of family time. Their language skills, annunciation and diction, and their comprehension of thematic postulations provided by the artists has simply leapfrogged their development to a place my wife and I never thought possible. Certainly farther than the school system ever showed us they were capable of. Pandora coupled with Discovery style educational shows, and of course lots of books readily available, has proven to help my children immensely. What truly fascinates me the most is the depth and breadth of the children's tastes. Whether it's children's songs, rockNroll, jazz, classical or pop, they always seem to find something they enjoy, and Pandora just keeps up with this eclectic blend of music with nary a hiccup. I truly feel Pandora has been an enormous catalyst for their growth and would feel utterly, truly, lost as a parent to them without it. Thank you for reading. Mike D.

Pandora is opening doors for obscure artists by uniting them with people who are interested in their music.

Why do government always have to come along take a disproportionate slice of the action? What are they putting in???

Those in the big record companies hate the fact they are loosing control and cannot dictate what we hear, and what they sell us. They have ripped us off long enough, stiffled creativity, the evolution of music and it's artists.

I have bought more CDs listening to Pandora than listening to the usual radio stations. Pandora lets me pick a genre and style that suits me, not a record company. Fantastic!!!

Long live Pandora, free internet radio, and freedom of choice. Let's hope "numpty" doesn't "kill the golden goose" again!!

I mostly work from my home. Pandora is on for most of the day. I have called both my senators and written letters. I am pleased with the reprieve but the real situation is symptomatic of a growing threat from the corporate world. Soon we will have no rights and corporations will run the governments. This is my ultimate fear which stems from corporate trends just like this one. They can only strip rights away if we let them. Keep this in mind when voting locally and nationally.

there are fewer and fewer local stations- they may be in a location but the programming comes from a central location and is controlled by the owner. The listeners are sheep waitting to be spoonfed what the owner wants them to hear.

I don't know if this was actually addressed above, but for anyone interested in the Copyright Tribunal's decision regarding statutory performance licensing for streams delivered to the UK, here's a link to the .pdf: http://www.ipo.gov.uk/ctribunaldownloadingdecision.pdf

On page 30, it appears that for pure webcasting in the UK, the rate is 6.5% of revenue OR £0.22 per subscriber per month (subscription model) OR £0.0006 per song per listener.

That basically amounts to $0.448007 per subscriber per month or $0.001221 per song per listener...if I understand the document correctly, and admittedly, I only scanned through the language...but the chart seems to be inline with what was referenced earlier in the document.

I love pandora, but a qualm I have with people lambasting "big record companies" is that those companies, along with organizations like BMI and ASCAP, are some of the only sure ways for musicians to make a living. My mother is a songwriter and as the downloading/opensource music era has taken hold, she's lost almost all income. "big record companies" were the only thing paying the bills for my mother, the relatively small-time songwriter and singer. If we are to really push for freedom of music, we have to commit to buying and paying for the music we listen to ESPECIALLY if the music does not come through a big label.

Posted by: nick lerangis at August 1, 2007 12:07 PM

oh, by the way, I absolutely LOVE pandora. I'm a music major entering my junior year of college and I'm an aspiring singer and musicologist. I wish I could work for something like pandora.

Posted by: nick lerangis at August 1, 2007 12:09 PM

Before I found Pandora I was so jaded by music I never thought I'd buy another album. The records I have bought recently, I bought only because I had heard almost every song from them via Pandora and knew that it wasn't going to be yet another album in which only the single is any good.

That fact alone proves what we guessed all along - that people are ready and willing to buy good albums, and stop buying albums when artists and labels get lazy and stop writing quality material. Is it really so much of a threat to allow people to hear albums in full for free before buying them? Or would that reveal the full extent of the lack of investment in properly developing artists?

Pandora *generates revenue* for record companies, and introduces us all to music we would never otherwise hear. Long live internet radio!

Posted by: Judy Johnson at August 1, 2007 03:14 PM

Nick - thanks for the thoughtful post on "big record companies." In spite of the intense negotiation we're in, Pandora agrees with you. We're not a basher of big labels. What we're specifically objecting to are rates (most forcefully advocated for by large labels), that are simply too high for internet radio to thrive. And that are not in the best interest of musicians. Much of this is just business - but in this case we really needed the help of listeners and congress to avoid an outcome that was irrational...

Cheers. Tim (Founder)

I just wanted to say, I love the music Pandora puts out. Unlike radio stations and music t.v. my input counts. Pandora does not link its music to the top 10 lists used all too often.

Internet Radio should not be put in an unfair situation. It should be on a level playing field with other media. I've let my representatives know the fees for internet radio need to be resonable.

Everyone keep up the good work. Together we will succed!

Secondly, One thing I would like to be able to do is go back to a song that already played. I listen primarily at work using an earphone (So, I don't cause trouble), and I sometimes have to leave my chair for minutes at a time. Though I could pause the song, I don't always have the opportunity to do so. So, I would like to be able to go back and listen to a song I missed.

Pandora Forever (I hope)

As a result of Pandora, I am buying more CDs than ever. Pandora introduces me to new music, some of which I like so much I want to hear more of it. The fact that "big music" wants to penalize net broadcasters such as Pandora for selling their products for them is ridiculous.

Was introduced to PANDORA here in the UK last week thru a friend. You are tops! Fantastic. I play my/your music EVERYDAY. From what I read, we might lose it here in the UK, but so far, so good. Each day when anxiously I put your music on, I am delighted you're still there... When I get back to Florida, I will immediately set up PANDORA, and phone whoever you want me to phone, to help keep you rockin'. You deserve to thrive and grow! Best regards, Carol

I've listened to Pandora since it was first mentioned on Slashdot, and shared it with everyone I know who shares my love for music. Your Music Genome database is the best thing that has ever happened to bring music and people closer together. There should be a nobel prize equivalent for the incredible work you've done here. You have my most sincere appreciation and admiration.

Thank you again for the wonderful service that you provide!

To Tim and all others who made Pandora possible,

I came across Pandora because I was annoyed at the lack of varity I hear from the radio and was hoping to find a different way so I could still enjoy the passion for music I have. I had been a radio listener for years, but it seems to have gone down hill. I could not understand how, in a world where music goes all the way back in our history, I couldn't find the music I so dearly love.

It seemed so one sided when it's all over the world. Like, it had been bled of it's culture. But thanks to you people, that changed. I am finally able to enjoy my love of music once again. Every time I listen, I write down the music that really hit home that I hear so that I may buy it when I am paid. Another thing that Pandora has done is that it not only renewed my joy for the music around me, but showed me a way to get it.

You guys are so caring about your listener base. It shows in all the little things you do and I confess, I'm rather touched. Again thank you, and let those record compaines know, it's because of Pandora that they even have my bisness still.

Pandora is everything I've been looking for when it comes to music on the internet. I'm getting real tired of everyone trying to take music away from the public for one reason or another. Everyone should not have to pay just to listen to a song! What ever happened to free speech? I wonder how Wolfe Man Jack and John Lenon would feel about this?

Posted by: Sasa at August 6, 2007 03:58 PM

I have been listening to Pandora since it was listed in one of PC Magazine's Best Sites on the Internet.

I could not agree more, the musical range, choices and control you allow is simply wonderful. It would be a shame if internet radio was removed. Like so many others, I have actually purchased an mp3 player to download and purchase the songs and artists that I have been introduced to through your service. Before, I was satisfied just listening to the same old stuff that was played on the radio. Now, I am constantly turning friends on to artists that they have never heard of.

It seems that the record companies are so good at finding illegal down-loaders, can't they also look at their data and see that sites like Pandora are actually helping their sales.

Please keep up the excellent work!!

Maybe the real answer is an internet radio music label that cuts out the traditional record companies altogether. That could get the dollars right in the pockets of the artists (and the necessary advertisers). Who needs the snakes anyway? Their day is past. Let's use the 'net to return power to all of us, not the few who only want to concentrate the wealth. Viva democracy!

Posted by: Richard Gay at August 9, 2007 07:05 PM

What do college radio stations pay to play songs? What does the NPR or public radio stations pay to play songs? These are both comparable outlets to your new technology in that they both introduce an avenue for unknown bands.

Which by the way, here's some unsolicited marketing advice. Start a cable-TV station!

The genius in American Idol is not that Simon Cowell is finding any talent in America. The genius is that we all know the artists names. The real reason the establishment is fighting you is because their way of doing business is spending gobs-of-millions-of-money to promote their stinking sell-out artists.

It's a YouTube world and I gaurantee you would have plenty of videos and artist submissions for the contests through Pandora.com to qualify for the best TV show ever! MTV sucks now and everybody knows it. Give us something to watch. Give us Pandora-vision.

I am 50 ,with an all-around-the- house audiophile music system, and an obscene ammount of cd's and LP's.How do I know wich music to buy? I listen first! In the last century it was on FM radio, the source of new quality material,if you knew where and when to tune in,now it is Pandora; 24/7 at your fingertips.
All my latest purchases were revealed by you,the new beacon for melomaniacs.
Stay on,hold the line,be spartans,we need you so much!
Not everyone treats music like a bag of chips, lots of us know that quality music, like anything of real substance, trascends fadish periods. All my real friends think accordingly.
You have opened music's posibilities to everyone's easy reach.Internet Radio will save the music and the musicians, the ones that ultimately matter...what will happen to the music industry ?... massive change, wich will be good.

Your product is, without a doubt,
THE BEST AVAILABLE ON THE NET!!!!

As that I am a believer in personal freedom of choice, I will myself kick a few folks in the shins to get their attention / alert them to the looming menace that is government intervention in an effort to control the freedom of the world wide web.

I think that musicians know themselves the benefits of exposure via the Internet can ultimately bring to their pockets via increased sales, but their publishers/handlers are so caught up in "next quarters revenue numbers" that they hurt themselves and us as consumers in their efforts to chase the almighty dollar.

And don't forget; Money is the ultimate power sought by people with large egos and short private parts, and is not to be discounted as a major motivator world wide.
The PEOPLE Must Keep Government In Check!
It is your DUTY as a free thinking citizen to exercise your every RIGHT to keep the bastards in check!!!!!
Blow this one off and the enemy (uncontrolled government) wins another one.
Everyone else (US) has lost another one.....!

Pandora Radio on the net is absolutely wonderful! Except for the conservative radio talk shows, this is the ONLY radio I listen to as all the others pale in comparison!

Unfortunately, the factions in our government not only are trying to take away the freedoms of our internet music, but just about every other freedom we enjoy today.

Our government is completely out of control with its concerted efforts to undermine all our freedoms, and it's being controlled by Communist factions that spin feel good slogans about how they're protecting our children and looking out for our health and education and welfare! If we citizens don't take steps to stop this wholesale attack against us, we are doomed to live under the control of Big Brother who will dictate to us every action we take. Little by little they are chipping away at our ability to make our own choices in life and determine our own direction.
Let's stand up and fight not only for complete unrestricted internet freedom but for every freedom we still have left in this country! If we don't, our children will be living in tyranny.

Thank you Pandora Radio for all your efforts!

All I have to say is, I work 12 hrs a day and without you guys i would feel like it was 20. Just like others have said, Listening to pandora has opened my eyes to alot of artist that would have otherwise never got my attention. I think every artist should be in support of this they arent losing any money by this... there are a million sites giving away music downloads for free, yet you guys are simply streaming music and throwing some artist at us at the same time. I hear a song I like and I go get the cd. Ever sence napster people have been in a frenzy over internet radio but they dont understand that streaming music is not the same as file shareing. How rich do these artist wanna get I mean there doing what they love and makin good money off of it. I make 50K and dont even like my job much now if I could make 50 million telling a story I wouldent mind if a good amount of people didnt pay to hear my story. They may not make money off us now but if we hear them and decide to buy there cd then they should be paying you a percentage not vice versa... well thats my .02 cents keep up the good work... Everyone at my job thanks you as do I

In lieu of returning all of the brand-new CDs I purchased as a direct result of hearing new musicians on Pandora, I will buy nothing but used CDs for the next year.

Hello all especially those in charge of Pandora,

As I see it, Pandora took a huge step backward for those of us who must rely on screen reader technology. This happened when the Adobe Flash Player was introduced and has become the norm. This Adobe flash player is not at all useable by those of us who need to use screen reader technology. It is practically impossible to hear any streams on any site using Adobe Flash Player. This truly stinks for me! I for one will not recommend Pandora to anyone now that Adobe Flash Player is being used and is the standard. It was bad enough to get Adobe Reader somewhat accessible for us but this is terrible! You think you have it bad that you could be shut down by royalty rates and I agree with you! How would you feel if you were shut out because a program is unuseable by access technology! Nobody asked us whether Adobe would be a good thing, the change simply happens and we with access technology are shut out! Streaming should be an effortless endeavor, one shouldn't need to be a software engineer to listen to streaming audio but this is happening more and more for us!

Don't feel bad! Music of your life dot com has adopted this cursed Adobe flash player as well and I can't hear their stream any longer! As I see it, you can take your Adobe Flash Player and shove it where the sun doesn't shine! Till a more suitable alternative can be found, I'm having nothing whatsoever to do with Pandora and I won't recommend it to others.

If on the other hand you are truly concerned about providing a suitable alternative, please contact:

Thanks for reading!

For Jim Aldrich and the programmers of Pandora.com

Please contact Jim Aldrich about this. Thanks.

Flash Player and Microsoft Active Accessibility

Adobe Flash Player uses Microsoft Active Accessibility (MSAA), which provides a descriptive and standardized way for applications and screen readers to communicate. MSAA is available for Windows operating systems only. For more information on Microsoft Accessibility Technology, visit the Microsoft Accessibility website at www.microsoft.com/enable/default.aspx.

The Windows ActiveX (Internet Explorer plug-in) version of Flash Player 9 supports MSAA, but the Windows Netscape and Windows stand-alone players currently do not.

Flex supports a debugger version of Flash Player that can display debugging information during run time, and generate profiling information so that you can more easily develop applications. However, the debugger version of Flash Player does not support accessibility.

CAUTION

MSAA is currently not supported in the opaque windowless and transparent windowless modes. (These modes are options in the HTML Publish Settings panel, available for use with the Windows version of Internet Explorer 4.0 or later, with the Flash ActiveX control.) If your Flash content must be accessible to screen readers, avoid using these modes.

To Canada Loves Pandora, to those in charge of this site and other interested parties,

Your comments are right on! The problem one faces is to what should I do about this! I of course feel that all concerned should contact
http://www.gwmicro.com/accessibility. This should be a good start in making Pandora more accessible with their music content. I'm able to read written material from this site but I'm not able to access the music at all! This truly is most unfortunate! It might not helpp the cause of the Save Net Radio movement when their sites are complaining about being shut down or shut out due to high royalties they may have to pay, to the music industry yet these same sites think nothing about shutting out those who rely on screen reader accessibility. This may or may not be intentional. I don't think this bodes well for the Save Net Radio cause! Congress might inquiry about how accessible this or other sites involved with Save Net Radio are for those who must rely on Screen Reading Technology. It's ironic that during a time when Pandora may be shut down or out, they would be excluding anyone from being able to enjoy their site to the fullest!

I will be inquiring further about this situation on other sites and lists. Others using screen reading technology will be stopping by to evaluate this site for accessibility. I certainly hope a solution can be found ASAP!

thanks for reading and thanks for your time!

Regarding the UK situation, I too read the Guardian Newspaper (ref to Karen Taylor's email 27th July)and concur with Karen that it seems to be the only media outlet so far to cover the story. If we know exactly what this means for internet radio in the UK we can start contacting our Members of Parliament - it can't be too late to get a campaign underway at the start of the next parliamentary term.

I would be grateful of any communication from anyone who can advise us of how we can do something in the UK. It would appear that 'SaveNetRadio' is a cause in keeping with the 'Pirate Radio Revolution'which has a proud history in the UK - if not always successful.

Listening to Pandora in the home office (well....shed!) has revolutionised the quality of my home working experience - please keep up the great work.

My flatmate introduced me to Pandora last year and having just taken delivery of my new computer i could'nt wait to register. Imagine my disappointment when i discovered i can no longer listen in the uk, i'm sending the computer back. Like everything in this world i assume it all boils down to money. Fight the power !

Listening to Pandora makes the work day go by much smoother and quicker. And it's great how you can create as many stations as you like and listen to the music that suits you at that very moment.

Power to the people! Isn't it interesting how an informed and outraged public can cause changes like this?

First save internet radio. After that, how about we show similar outrage and change the federal government.

Well maybe not, but at least Pandora now has a better chance....

A coworker was listening to your station when i went into his office and i asked him what cd was he playing or would he sell it to me and he informed me that it was on the internet and i have been a Strong fan and member eversince. Man i just want to say THANK YOU very much for creating this radio station because it is very hard these days to listen to the music that the artists originaly record in its rawest form not the commercial stuff that is out on regular radio stations. I dont even listen to regular radio and i will spend my money on thing like the pandoras box so i can continue to listen to music as it is not what the government has put out or say how we should listen to it. I have told everyone i know with a computer and they love it and say that they do not know how they have been getting along with out it before....

I've just started using Pandora and it's brilliant! The internet is not the only medium for ad free music, cable has it too, so why the issue with the Internet?
We are sending a newsletter to 400 clients and we are adding your website address as a cool website to use.

I have lost all interest in commercial radio music stations. It's a wasteland out there. Pandora has provided a wonderful alternative. It has also turned me on to new artists I wouldn't have heard before, and reinvigorated my desire to purchase music again.

Thanks Pandora. You will get my support now and in the future.

Tim,
Thank you for the emails and your constant effort to keep internet free or at the very least at minimal cost.Your efforts have not gone unrealized. I am typically not a blog reader and never respond to blogs, but after reading this blog and seeing the support that your listeners (myself included)have for Pandora I couldn't resist an entry here. I have left messages with three councilmen in my area, including my senaturd i mean senator. Anyhow I love the format of your radio station and I hope TOGETHER (you and everyone who listens to pandora) can convince Big Brother to do away with the absorbant fees that are on the table and we can all continue our lives as normal with free music when we want it. I have seen a disabled family on this blog, an American Soldier deployed for Iraq, older couple and people like myself who just listen to Pandora while at work to make the day go by easier. We are all different and listen for different reasons, but we all agree. INTERNET RADIO SHOULD BE FREE OR AT MINIMAL COST. THANKS TIM.

wow... i mean really just plain wow... my dad turned me on to this and since then its been nothing but this, and i used to play music on youtube!

Posted by: zak at August 18, 2007 07:43 PM

First off, Keith... /salute Come home safe! You are in our thoughts.

Mike...brightest blessings to you, your wife and your children. I hope your children flourish and that you and your wife live long, healthful lives with them.

Tim and the Pandora staff;

I really don't know where to begin except to say that Pandora has become a staple in our household and we have shared it (and continue to) with everyone that we know.

I work from a home-based studio due to my health and because I chose to homeschool my little girl. I suffered mild neurologic damage several years ago as the result of a doctor's misdiagnosis and focusing on my work, and most everything else, has been difficult since. I normally listen to music - mostly game and movie soundtracks - for background when I am writing or working in my studio. I am very eclectic in my tastes so stopping to change CDs or swap out music on my computer is disruptive at best. I also spend a great deal of time at home and there isn't an available radio signal so I miss out on current music.

Pandora has opened worlds for us...

I have found more new music in the last couple of weeks, obscure groups that I would never have found, than I have in the last several years. I would think Pandora would be a boost to music sales elsewhere; we have been picking up CDs for the new artists we have found here like crazy in stores and on iTunes.

My whole family enjoys Pandora now and I cannot thank you enough for what it means to us. Keep up the good work, we are behind you and we are helping to protect what you have created here...

Thank you.

I almost can't believe it's true that such a station as Pandora exists! I tell all my music loving friends your website. The work day is more better. New artists have a great forum.

Man, oh, man. With each passing week I continue to be amazed at the power of music - the world's most universal meeting place. Thanks to everyone here for the great support (not just of Pandora, but of eachother) - and thanks for amazing list you put together, Keith. We're sinking our teeth into it as we speak...

It continues to be a great pleasure to correspond with all of you. Don't worry, with the kind of public support we've been getting there's no way Pandora we'll be stopped...

Cheers to all you. Tim (Founder)

Tim and crew,

Great work! If there is any way I can ever help, let me know. If you ever need to come lobby the FCC or the music publishers here in Nashville, let me know and I'll gladly put you guys up.

In the meanwhile, I'll definitely subscribe and will start saving up to put in a sound system from one of your partners. Pandora in every room. What bliss.

Keith, thanks for your service. Please come home safe.

Oh, one more thing: I read the FAQ concering classical pieces. How's that coming? I'm a big fan of choral pieces like Arvo Pärt's "Te Deum".

Just wanted to say I love Pandora. I was in the Navy for 4 years, stationed in Japan for 3 and half of those. My Fiance and I would listen to all different kinds of internet radio. It was good because I could here new stuff coming out that I wouldn't have been exposed to in Japan, and my fiance was Japanese, so it was so much easier for her to find music she liked via internet radio, because she could grab the artist / album / song name. She liked what they were playing in the clubs there, but you can't go up to the DJ every song and ask him what he's playing. I have gone out and bought CD's of bands I've heard on internet radio. I love Pandora's format, and how you guys link similar artist and songs. I've been playing guitar for more than a decade, and I am still amazed at how you guys do it. I was kind of at loss when the internet radio menu from Windows Media Player disappeared, then I found Pandora, I would really hate to see Pandora disappear as well. Being a musician myself, I can see their point of view, and I feel for them, but I think internet radio helps sells CD's, because if the CD is good enough, people will buy it, I think that's in where the problem lies, most CD's only have 1 or 2 decent songs on them, and 1 or 2 songs is not worth the price of a CD. Anyways, I've rambled long enough, I just wanted to say I applaud you guys here at Pandora, and hope you guys can keep streaming free internet radio.

Posted by: Jim at August 21, 2007 05:58 AM

I am a new Pandora listener and I fell really excited about the music I hear on the site. It's a really intense mix of new and old music, whatever or whoever you want to listen to. I LOVE IT!!!!

Posted by: Marcia Bingham at August 21, 2007 08:03 AM

Your streaming system - station - whatever it is, has whisked me away on a journey through trance unparalleled by anything I've heard before. To put it simply, Pandora is an eargasm! Thanks to everyone involved in creating this ingenious system, keep up the good work :D

The music industry's behaviour concerning internet distribution has been absolutely disgraceful. Here's one example: my cousin, who's in the industry but not one of the parasites attempting to suck it dry, tells me that artists will see about an eighth of what you pay for a track at a certain popular online store. With the millions that must be made from online stores and the other various distribution methods, most of which involve depriving the artists, how in the hell can they demand sites like Pandora to cough up thousands more? (I've got my theories but I don't want this site in the hot water for my opinions.)

I can only hope the issue is thrown open by governments of other countries sooner rather than later, as the site has at the time of writing now blocked access to listeners outside the US, except "in a few countries" (with DMCA-esque laws in place?).

Finally, a note to the developers: surely it would be very easy for an international citizen to spoof a US zip code, which then gives anyone outside the States access to the services? Wouldn't this potentially violate some law or another? I suggest you look into this, we can't afford to lose such a revelation in music as yourselves.

Tim,
Have been listening to Pandora for a few years now.

I am anxiously waiting to see what happens with legislation. I can't imagine not having feasible access to music I would never otherwise find.

I would love to buy a system for bigger sound in the house.

Thanks for all the hard work and best of luck.

I didn't think it was possible for someone so close to the music industry, regardless of genre or demographic, to find much more new music, but I have, thanks to Pandora. Some of it is just older stuff from people I already like. However, some of it is brand new to me. This station is art unto itself and deeply appreciated. The only three albums that I have not seen here that I know exist are Beautiful Creatures debut on Warner Brothers, either of the Spread Eagle cds on MCA and the Sea Hags on Chrysalis. All four were five star reviews in Kerrang, just ill timed or marketed incorrectly. I'm certain Joe Leste would be the first to acknowledge the importance of timing.

I just spent my birthday listening to Pandora.com and I must say it really makes any day that much better. I heard songs I would not hear anywhere else because the songs were from the 70s and it took me back to when I was a kid.

It burns me to no end that groups of people want to control what people listen to by demanding ungodly amounts of money just to play them..... That form of mind control is despicable not to mention evil..... Keep up the great work!!!!

Posted by: J D at August 21, 2007 07:16 PM

I sincerely hope, wish, genuflect, bow, salute, wink, and any number of respectful things that I can do to all of you that are making Pandora stay what it is. I hope my 2 cents helps as well.
THANK YOU. Music is my life and I can't have Congress or the money suckers take that away. Rock on and on and on and on.
